Terms and Conditions

IMPORTANT NOTICE

These Terms govern purchases from Hux Hampers Ltd. They are intended to be read with our Delivery and shipping policy, Privacy Notice and Returns and Refunds Policy. Nothing in these Terms reduces rights that cannot lawfully be excluded. By purchasing from us you agree to be bound by these terms.

1. About Hux Hampers and these Terms

1.1  “Hux Hampers”, “we”, “us” and “our” mean Hux Hampers Ltd, a company registered in England and Wales under company number 9254036. Our registered office and address for service are 7 Church Walk, Trowbridge, Wiltshire BA14 8DX. Our VAT registration number is 362 822 986. Email: enquiries@huxhampers.co.uk. Telephone: 01225 541555.

1.2  These Terms apply to orders placed through our website and, where applicable, by telephone or email and at site location. A “consumer” purchases wholly or mainly outside their trade, business or profession; a “business customer” purchases for business purposes. Specific written terms may apply to larger corporate or bespoke orders.

1.3  If a separately agreed corporate quotation expressly conflicts with these Terms, that quotation governs the relevant business order. Nothing in any document overrides mandatory consumer rights.

2. Products and descriptions

2.1  We carefully select food, drink and gift packaging, often from independent British producers. Product descriptions, quantities and principal features are shown on the relevant product page. Photographs are illustrative; props are not included unless expressly listed.

2.2  Packaging, colours and minor product presentation details may vary. We will not materially alter an order without addressing the change appropriately. Any substitutions are dealt with under clause 10 and our Returns and Refunds Policy.

2.3  We aim to supply ambient food products with approximately 28 days or more of remaining shelf life on delivery and, where suitable, chilled cheese and other short-life products with approximately 7 days or more. These are operational targets, not an unconditional guarantee. Some seasonal, artisan or naturally short-life items may have shorter dates, which will be explained where material. Always follow individual product use-by dates and storage instructions.

3. Order Acceptance

3.1  By submitting an order, you confirm that information you provide is accurate and that you are authorized to use the payment method. You must provide an email address and an accurate complete delivery address, including any relevant access instructions.

3.2  Following successful payment, Hux Hampers Ltd will automatically email the customer acknowledging and confirming their order. For standard website orders, this confirmation constitutes acceptance by Hux Hampers Ltd. If an accepted order cannot be fulfilled, we will contact the customer promptly about an appropriate alternative or refund as required by law. Separate written acceptance arrangements may apply to individually quoted corporate and bespoke orders.

3.3  We may decline an order where an item is unavailable, payment cannot be authorized, delivery cannot reasonably be arranged, there is an obvious pricing error, or legal age-verification requirements cannot be met. Where payment has been taken for an order not accepted, we will refund it.

3.4  Please review recipient names, gift messages, selected products, dietary choices, contact details and addresses carefully before submitting your order. Notify us promptly of corrections; changes may not be possible after preparation or dispatch.

4. Pricing and Payment

4.1  P rices shown at checkout will include applicable VAT. Delivery charges and optional upgrades will be shown before the order is placed. VAT treatment may vary among items within a hamper, as not every item in a Hamper is subject to VAT.

4.2  Payment for all standard website orders is due in full at checkout, processed securely through Stripe. The payment methods available will be shown at checkout. For corporate and bespoke orders arranged by quotation, full payment is due when the order is placed or the quotation is accepted, in accordance with the agreed written payment instructions.

4.3  Full payment in advance is our standard requirement for business-to-business orders, including orders over £1,000. For corporate orders exceeding £1,000, Hux Hampers Ltd must receive payment in full in cleared funds before we commit to ordering stock, purchasing bespoke materials or commencing production. We may, at our discretion, agree alternative payment arrangements in writing with established repeat corporate customers as our business develops. No credit or instalment terms apply unless expressly agreed in writing.

4.4  Promotional codes apply only within their stated dates, eligibility rules and exclusions. We may correct an obvious pricing or description error before accepting an order, offering the option to proceed at the correct price or cancel.

5. Delivery

5.1  Delivery destinations, charges, services, geographical exclusions and order cut-off times are stated in our Delivery and Shipping Policy and displayed where applicable at checkout. Only delivery services made available for the relevant product and postcode may be selected.

5.2  Customers may select the preferred delivery date at checkout. Unless a date is expressly confirmed as guaranteed, it is an estimated delivery date. Any material delay will be handled in line with the Delivery and Shipping Policy.

5.3  You are responsible for supplying accurate delivery and recipient details. We may contact you if a courier reports an access issue, incomplete address, failed age check or attempted delivery. Additional redelivery or replacement costs caused by incorrect information or recipient unavailability will be payable, where lawful and disclosed.

5.4  Risk of loss or damage passes to a consumer when the goods come into the physical possession of the consumer or someone they identify to receive them, subject to the law.

5.5  Recipients of chilled goods must be available to receive delivery, open the package promptly and follow the temperature and storage instructions supplied. Please notify us immediately if chilled goods are delayed or arrive unsuitable for consumption.

6. Chilled Food Products

6.1  Some hampers contain fresh cheese or other foods requiring chilled transport and prompt refrigeration. Product labels and supplied storage instructions must be followed, including “use by” dates. Do not consume goods that appear spoiled or have not been kept safely.

6.2  Conditions for chilled delivery, including eligible postcodes, dispatch days, insulated packaging and any additional charges, will be explained in our Delivery and Shipping Policy and/or at checkout before purchase. Recipients must follow supplied food-safety and refrigeration instructions.

6.3  Our remedies for delayed perishable products are detailed in our Returns and Refunds Policy. These Terms do not exclude responsibility for goods that arrive unsafe, faulty or otherwise not as agreed.

7. Allergy and intolerance disclaimer

7.1 Our products may contain or may have been produced in environments that handle allergens, including but not limited to gluten, milk, eggs, nuts, seasame, eanuts, soya.sulphites, nustard, celery, fish, crustaceans, molluscs and lupin and other potential allergens.

7.2 It is the responsibility of the person ordering and the recipient of the Hamper to read the ingredients and allergens listed on the individual products and on the manufacturers labels and websites. Hux hampers accepts no responsibility for adverse reactions where product labels and  allergen information have not been checked before consumption.

7.3  Although we take care when selecting and packing products, hampers may be assembled or handled in environments where allergens are present. We cannot guarantee that any of our Hampers or products are free from allergens or suitable for anyone with allergies or intollerances.

7.4Please contact Hux Hampers ltd at enquiries@huxhampers.co.uk if you require information regarding allergens or have any specific dietary requirements before ordering.

8. Alcohol and age verification

8.1  Hampers containing alcohol may only be purchased by customers aged 18 or over and sent to recipients aged 18 or over. At checkout, the purchaser must actively tick a required declaration confirming both that they are at least 18 and that the intended recipient is at least 18. An alcohol-containing order cannot be submitted without this declaration. We do not assume any legal responsibility for false statements about age.

8.2  Alcohol deliveries are subject to applicable carrier acceptance rules and age-verification procedures. The recipient must cooperate with any required identification check at delivery; the courier may refuse to hand over alcohol where the required check cannot be completed. Any additional charges resulting from a failed delivery will be handled in accordance with the Delivery and Shipping Policy and applicable law.

8.3  Alcohol will only be dispatched using delivery services that Hux Hampers has verified are authorised to carry the relevant products and can provide the age-verification arrangements required for that service. Specific courier services and geographical availability may change and will be subject to the Delivery and Shipping Policy.

9. Gift messages and personalisation

9.1  Where offered, you may submit a gift message for inclusion with the hamper. You are responsible for its accuracy and for having permission to provide another person’s details. We may refuse unlawful, abusive or otherwise inappropriate content.

9.2  Personalized branding, engraving, printed packaging and tailored contents are subject to written approval of artwork, specifications, lead times and price. The customer warrants that they have permission to use logos or materials supplied for personalization.

9.3  A choice from standard catalogue options does not automatically mean that goods are legally bespoke. Applicable cancellation rights and any exclusions are set out in our approved Returns and Refunds Policy and consumer law.

10. Availability and substitutions

10.1  Due to availability, seasonal supply, packaging changes or supplier updates, some products may be substituted. We reserve the right to substitute these items with replacements of equal or greater value and comparable quality, which may not be listed in the contents and product descriptions on our website.

10.2 For Hampers which are for special dietary requirements, suitable substitutions will be made.

10.3 We will always aim to maintain the quality and overall theme of the hamper.

11. Cancellations, returns, damage and refunds

11.1  Please refer to our Returns and Refunds Policy for our procedures on cancellations, returns, damaged items, delayed perishable items, refunds and substitutions.

11.2  Under applicable consumer law, eligible distance purchases generally have a 14-day cancellation period after receipt and a further 14 days to return cancelled goods. Certain goods, including items liable to deteriorate or expire rapidly and genuinely personalized goods, will be exempt.

11.3  Our requests for early reporting of issues and photographs help us resolve matters promptly; they do not remove remedies for faulty, damaged, misdescribed or incorrectly supplied goods. For ordinary change-of-mind returns, consumers will be responsible for return postage.

12. Corporate and bespoke orders

12.1  Corporate and bespoke enquiries will be quoted individually to reflect quantities, branded packaging, dietary instructions and delivery to multiple addresses. Corporate quotations must specify the agreed products, specification, delivery arrangements and any special terms. An individually quoted order becomes binding at the acceptance point stated in that written quotation or order agreement.

12.2  Business-to-business orders are payable in full when placed or upon written acceptance of the quotation. For business orders exceeding £1,000, payment must have cleared before Hux Hampers commits to stock procurement, bespoke materials or production. If a business customer cancels an accepted order, Hux Hampers may retain the reasonable, evidenced costs and losses directly arising from cancellation, including committed stock, packaging, branding, production and reasonable administration, allowing for expenditure avoided and opportunities to reuse or resell goods. Any balance will be refunded. Advance payment does not mean that the entire payment is automatically non-refundable. Alternative terms may be agreed in advance and in writing with established repeat corporate clients. Consumer statutory rights are not affected.

12.3  Business customers must ensure recipient information is accurate and that they have an appropriate basis to share addresses and personal data. We will handle personal data under our Privacy policy and applicable law.

12.4  Business-to-business orders may have negotiated terms separate from consumer cooling-off arrangements. Nothing affects any mandatory rights or liability that cannot lawfully be excluded.

13. Liability

13.We are not liable for;

  • Damage of products due to mishandling after delivery
  • Incorrect information provided by purchaser causing losses
  • Delays caused by third party couriers
  • Allergic reaction or health issues, where product labels, allergen information, storage guidance or use by dates have not been checked before consumption.

13.3 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded. Nor do these Terms restrict consumers’ statutory rights.

13.4 Our liability is limited to the value of the order placed.

14. Website information, privacy and changes

14.1  We aim to keep website information accurate and available but may update products, offers and site content from time to time. Changes to these Terms will not retrospectively alter orders already accepted unless permitted by law or agreed with the customer.

14.2  How we collect and use personal information is explained in our Privacy policy. Any marketing communications will be handled in accordance with applicable consent and direct marketing rules.

14.3  Our website content, photographs, branding and original text are owned by or licensed to Hux Hampers unless otherwise indicated. They must not be commercially reproduced without permission.

15. Governing Law

15.1 These terms are governed by the Laws of England and Wales. You agree that the Courts of England and Wales have exclusive jurisdiction.
